Village Grande at English Mill Charter Alternative Dispute Resolution Committee Mission: To provide opportunities for Homeowners/Residents and the Homeowners Association of Village Grande of English Mill (HOA) to resolve disputes either between Residents, or between Residents and the HOA, or between Residents and Committees. This will provide an opportunity for the parties involved to resolve or clarify issues or concerns with an alternative to litigation. Vision: To provide an opportunity for the involved parties to present a concern or dispute to an independent, unbiased committee of their peers to reach a mutually satisfactory resolution to their dispute. Values: The Alternative Dispute Resolution Committee (ADR) will treat all members of the Community with respect as each participant presents their concern. The Committee will conduct all meetings in a good faith manner with the intention to resolve the issues between the parties Objectives: The ADR Committee is responsible for working with Residents and/or the Board of Trustees of VGEM to assist in resolving items and issues of concern within the community. 1. A written request must be made in writing and submitted to the Community Manager. The form must be completed in its entirety before submission to the Committee. A desired outcome must be included in the request. 2. Once notified by the Community Manager that an ADR request has been made, the committee will advise the parties as to procedures, timelines and process as guided by the Village Grande at English Mill's Alternative Dispute Resolution Policy (Policy 13, dated September 8, 2020). 3. Participants will be advised of the options for both mediation and arbitration along with the limitations, constraints, and guidelines of each option. 4. The Committee will keep accurate and detailed records of the Committee's activities. 5. Confidentiality must be maintained for all parties involved. 6. By-Laws Article XII: Section 12.05 The ADR Committee shall have the duties , g power and authority, by resolution of the Board of Trustees, to resolve disputes arisin under and enforce the provisions of the Governing Documents including the right to: a. Impose cease and desist orders. b. Levy fines pursuant to Section 12.02 to the extent permitted by law. Membership: 1. Per the New Jersey Condominium Act and the Planned Real Estate Development Full Disclosure Act no member of the ADR Committee may be an officer of the Association or a unit owner involved in the dispute. Employees of the Association cannot be the provider unless the dispute is between two-unit owners. y 2. Members will be appointed by the Board of Trustees and may be removed b the Board of Trustees.
